Building A Compliance Roadmap: Understanding The Cost Of Compliance

As the recent high profile cases brought by FCPA are highlighted and Data Protection scandals are brought to light it is no secret among European firms that there are no clear guidelines for them to follow or definite models for them to adhere to. Although it is clear to say the expense of auditing, investigations and training is far out weighed by the financial and corporate cost fines will bring. This session provides key fundamental points that need to be considered when developing an enterprise-wide corporate compliance framework:

  • Defining and monitoring the level of compliance within your organisation
  • What are the pro’s and con’s of using ‘value’ based or ‘rules’ based systems?
  • Getting your message across, training and implementing compliance initiatives.

Reviewing Best Practice In Trans-Atlantic Data Transaction

Understanding Your Position In Competition Law

Case Reviews

Effectively understanding Anti-Trust compliance is a complex task, especially as you need to be aware of competition laws across multiple jurisdictions. Organisations with a global footprint know only too well the importance of monitoring global politics and cultures in an effort to analyse antitrust worldwide.

This session will draw on the experience of General Counsel who have worked effectively with competition authorities and can give productive advice on investigations and risk mapping.

  • What impact will reform on the current EU Block Exemption Regulation on Vertical Restraints have on competition?
  • How can you gauge a clear idea on how competition and antitrust authorities view the market place?
  • What can you do internally to mitigate against these risks?

Business Intelligence for the Legal Department: Harnessing Data to Drive Results

The increasing availability of legal management information greatly expands the ability of corporate legal departments to manage all aspects of the business of law. Business intelligence tools, processes, applications and practices facilitate nearly endless legal management opportunities which legal departments should embrace and effectively utilise.

All of those opportunities depend, however, upon the legal department’s ability to leverage business intelligence by analyzing, using and delivering that information. Doing so requires the generation of well structured reports. The wealth of available information and the many ways by which data can be analyzed and packaged makes it imperative that a reporting strategy is carefully considered and crafted.

This presentation introduces an intuitive method by which to isolate critical information, prioritize legal management strategies and deliver essential reports. Topics will include:

  • The importance of matter and financial information
  • The power of data segmentation
  • The nine types of reports and their purposes
  • The dissemination of reports
  • Measuring quality, cost and service

Risk Factor Vs. Cost Factor

Co-Presented Debate

The debate continues over the practicalities of using LPO’s within your legal department, especially as efficiency and productivity remains a high priority for General Counsels today. By outsourcing T&C contracts, drafts and the organisation of litigation documents legal departments can and do cut down on time and costs, allowing for internal resources to be allocated to higher value work. On the flip side it raises some serious questions surrounding quality control and risk. What does using an LPO mean for customer service?

This session invites two different organisations to co-present and debate the benefits and disadvantages of using captive legal services and using offshore legal services.

Establishing The GC’s Role In Reducing Deal Cycles With Efficient Case Management

Panel Discussion

Emerging post-economic crisis the clear focus is to rein in costs and manage time pressures. It is now overwhelmingly clear that General Counsels are prioritizing the efficiency of processes and costs of operations within their legal departments. Cutting down the time spent dealing with routine contracts is a good starting point to develop automated processes both internally and externally. This session explores the key functions and services that Contract Management solutions brings to in-house legal departments and how GC’s should work with it:

  • Implement automised processes for customer/ supplier contracts
  • Save time by distributing documents online instantly Organize and locate contracts and documents: Use a single, categorized repository for the most up-to-date information
  • Ensure confidentiality by managing individual access on a per document basis

Learning From Recent Trends In ADR

Practical Case Reviews

The credit crisis has not only sparked an increase in litigation but has caused legal departments to review and reshape their internal capabilities, addressing core skill sets, including key negotiations styles. ADR has increasingly been used over litigation as a more cost effective and time efficient tool. However mini trials, mediation processes, arbitration and direct negotiations have had their negative experiences aswell as good ones and it is often difficult to put into practice without the correct guidance or prior knowledge.

This session will ask leading experts to highlight their own experiences in ADR, revert to recent cases and give practical advice on how to facilitate ADR effectively.
